You have a client whose estate has gone cross-border, or turned out to hold crypto, or needs a farāʾiḍ distribution. You do not want to turn the client away and you do not want to learn a new specialism for one file. You introduce them; we do that piece; you keep the relationship.

Where we are useful, and where we are not

Send us

Estates with assets in more than one country. Forced-heirship and situs problems. Choice-of-law elections. Farāʾiḍ distributions that have to work as English wills. Crypto and digital assets in life or in an administration. Foreign grants and resealing.

Do not send us

Anything contentious - a will challenge, a 1975 Act claim, a removal application. Those are reserved legal activities and we do not do them. We will say so on the first call rather than three weeks in, and we would rather refer it on than hold it.

Read this before you refer anything. iProbate is not a firm of solicitors, does not carry out reserved legal activities, and does not yet hold professional indemnity insurance - cover is being arranged. If you are regulated, that is a fact about your supply chain that your compliance officer will want to know, and your own rules on referral arrangements and disclosure apply to you regardless of what we agree. We would rather you checked and declined than found out later.

Common questions

Can a regulated firm pay or receive a referral fee for probate work?

Generally yes - the LASPO ban on referral fees applies to personal injury, not to probate or estate planning. But if you are regulated, your own rules govern you, not ours: the SRA Code requires that any referral arrangement is in writing, that the client is told about it and about the fee, and that it does not compromise your independence. We put every arrangement in writing and we expect you to disclose it. If your compliance officer says no, that is the end of it and we will not press.

What do you actually do on a referred matter?

Only the piece you refer. If you send us a cross-border will, we draft the cross-border will. We do not review your other work, we do not pitch the client on anything else, and we do not take over the relationship. That undertaking is in the agreement, not just on this page.

Are you insured, and are you regulated?

iProbate is a self-employed sole practitioner and an Affiliate Member of STEP (no. 302475). We are not a firm of solicitors and we do not carry out reserved legal activities under the Legal Services Act 2007. We do not yet carry professional indemnity insurance; cover is being arranged and this page will say so the day it is in force. For a regulated firm that is a material fact about your supply chain and you should weigh it before referring. We would rather lose the partner than have that surface later.

What are the commission rates?

They are agreed in writing with each partner before any work is referred, because a single high-value cross-border administration and a stream of straightforward Shariah wills are not the same commercial proposition. We would rather quote you honestly than publish a headline rate we then vary.

Is there a minimum volume?

No. Referral partners are welcome to send one matter a year. Reseller arrangements need enough regularity to be worth papering, which in practice is a handful of matters a quarter.
